Jomshof’s case appealed by Näthatsgranskaren after prosecutor closes investigation in Sweden

In May, Richard Jomshof, a member of the Sweden Democrats (SD), was reported for incitement against a group by the organization Näthatsgranskaren after he shared two Islam-critical drawings on the X platform. The case was handled by a special prosecutor’s office, which decided last week to discontinue the preliminary investigation after interviewing Jomshof. Prosecutor Joakim Zander stated that Jomshof claimed his intent was not to portray all migrants or immigrants as criminals or violent individuals, but rather to engage in a debate about migration.

However, the decision to close the investigation has now been appealed by Näthatsgranskaren, resulting in the case being transferred to a special department within the Swedish Prosecution Authority that reviews prosecutor decisions. Emelie Källfelt, a senior prosecutor in this department, noted that it serves as a second legal level within the agency, similar to an appeals court. While it is uncommon for a senior prosecutor to overturn a decision made by another prosecutor, this route remains available.

Thus far, the responsible senior prosecutor has not responded to inquiries. Both Joakim Zander and Richard Jomshof have declined to give interviews. In light of the prosecutor’s closure of the investigation, Jomshof remarked that the matter has sparked a discussion about the limits of free speech.
