Finland legalizes nicotine pouches amid market regulation changes

Nicotine pouches, previously considered illegal in Finland, are now widely sold in stores, gas stations, and specialized shops. These pouches contain high levels of addictive nicotine but do not include tobacco, unlike traditional snuff. The Finnish Parliament recently passed an amendment to the tobacco law that regulates the market for these products by prohibiting remote sales and limiting allowable flavors.

Finland’s approach to nicotine pouches has shifted rapidly, largely influenced by a legal case surrounding a single order placed in 2020 for banned nicotine pouches from a Swedish online store. The case, which resulted in an appeals process reaching the Supreme Court, eventually led to a legal clarification. The Finnish medicines agency, Fimea, advised that nicotine pouches do not meet the criteria to be classified as medications, which subsequently allowed their sale to resume in the spring of 2023.

The ministry expressed concerns in meetings about losing control over the situation, hoping to find ways to prevent the pouches from entering the market. However, following government negotiations after the April 2023 elections, it became clear that the new cabinet did not intend to ban these products due to their anticipated tax revenue.

Following official discussions with major tobacco companies and compliance with regulatory feedback, the law was adjusted to allow specific flavors popular among users. This change ultimately benefits both local manufacturers and large tobacco companies operating in Finland. Finland’s long-term goal remains to be a smoke-free and nicotine-free nation by 2030.
